Terms & Conditions
1. In this Agreement the following terms shall have the meanings hereby respectively assigned     to them:

Hirer: The person named as such overleaf

Excess Amount: The sum of £750.00, reduced to £450 if the insurance waiver is purchased

Driver: The Hirer and/or person named as such overleaf or any other person previously approved by the Lessor to drive the vehicle

Excess Waiver Fee: A fee calculated in accordance with the Lessor’s current tariff which relieves the Hirer of part liability to pay the excess amount

Vehicle: The original vehicle described overleaf or any replacement vehicle

Personal Accident, Personal Effects & Goods In Transit Insurance Fees: Fees which entitle the Hirer to benefits of the cover set out in the master policies issued to the Lessor

Accessories: The spare wheel, tools and other items with which the vehicle is supplied and any replacement thereof

Current Tariff: The Lessor’s tariff current at the commencement of hire

Rental Period: The period from the date and time out stated overleaf until the re-delivery of the vehicle into the physical custody of the Lessor

The Insurance Policy: The Lessor’s policy of insurance on the vehicle and copy of which is available for inspection at the main office of the Lessor.

Rental Charges: The hire charges for the rental period calculated in accordance with the Lessor’s current tariff

2. The Hirer acknowledges that the vehicle is fit for purpose and is in good condition and     undertakes to return it and its accessories in the same condition, fair wear and tear     excepted, to the place and on the date due back, specified overleaf.

3. During the rental period the Hirer shall keep the vehicle and its accessories in good condition     and repair, and will be liable for costs and expenses of maintaining and repairing the vehicle.     Loss or damage to the vehicle will become the responsibility of the Hirer and the Lessor     should be notified immediately. In the event that the vehicle is lost or damaged beyond repair,     the Hirer shall pay the Lessor the replacement cost of the vehicle; in addition, the obligations     of this Agreement shall continue in full force and effect through the Rental Period. The Hirer is     not permitted to carry out any structural modifications to the vehicle without prior consent of     the Lessor.

4. The Hirer and any driver shall ensure that the vehicle will not be used:

a) for hire or reward.
b) for racing, pacemaking, rallying, speed testing, driving tuition or similar purposes or for     propelling or towing any vehicle, trailer or other object.
c) in any manner that might render void the insurance policy or other contract of insurance.
d) for any illegal purpose or in contravention of any legislation affecting the vehicle, its use or     construction.
e) by any person who:

(i) is not licenced to drive the vehicle
(ii) does not hold a full valid British driving licence, a valid British (visitors) or foreign driving     licences or a valid international Driving Permit
(iii) is under 21 years of age of over 70.
(iv) is under the influence of drink and drugs.
(v) have given a fictitious name, age or address.
(vi) has not been approved by the Lessor as a driver.
(vii) has been convicted of a motoring offence, of which the details have not been disclosed in     writing to the Lessor at the commencement of hire.

f) outside England, Wales or Scotland without the prior consent of the Lessor.

5. The Hirer agrees to pay on demand

a) rental charges.
b) any appropriate Excess Waiver or Personal Accident, Personal Effects or Goods in Transit     insurance fees.
c) the excess amount in respect to each incident resulting in damage to or loss of the vehicle,     its accessories or any property left stored or transported in or upon the vehicle.
d) any additional costs incurred due to the late return of the vehicle.
e) Even though it might be the Lessors insurance, the hirer shall be liable to pay the cost of     repair or replacement for any damage suffered by the vehicle as a result of wilful action of the     Hirer, driver, servant or agent.
f) To pay on the Lessors current tariff for rental and fuel to pay for any accessories, tyres or     equipment lost, stolen or damaged, to pay the Lessor costs of recovering the vehicle in the     event that the Hirer fails to return it to the Lessor, to pay any penalties and court costs     incurred during the rental period and which the Lessor is obligated to pay (save when caused     by the fault of the Lessor) and to pay VAT, where appropriate the current rate.

6. The customer undertakes to ensure that the correct tyre pressures, engine oil, battery fluid,     screen wash, coolant and transmission oil levels are maintained throughout the period of the     rental

7. The Hirer shall keep the vehicle free and clear of any liens or other encumbrances, and shall     not permit any act where the Lessor’s title or rights may be negatively affected. The Hirer     shall be responsible for complying with and conforming to all laws and regulations relating to     the possession, use or maintenance of the vehicle. Furthermore, the Hirer shall promptly pay     all taxes, fees, licences and governmental charges, together with any penalties or interest     thereon, relating to the possession, use or maintenance of the equipment.

8. The vehicle is and shall remain the exclusive property of the Lessor.

9. If any part or parts of this Agreement shall be held unenforceable for any reason, the     remainder of this Agreement shall continue in full force and effect. If any provision of this     Agreement is deemed invalid or unenforceable by any court of competent jurisdiction, and if     limiting such provision would make the provision valid, then such provision shall be deemed to     be construed as so limited.

10. The covenants and conditions contained in the Agreement shall apply to and bind the Hirer      and their heirs, legal representatives, successors and permitted assigns of the Hirer.

11. This Agreement shall be governed by and construed in accordance with the laws of England     and Wales. The English Courts will have exclusive jurisdiction to deal with any dispute which      has arisen or may arise out of, or in connection with, this Agreement, except that either      party may bring proceedings for an injunction in any jurisdiction.

12. This Agreement constitutes the entire agreement between the Hirer and Lessor’s and      supersedes any prior understanding or representation of any kind preceding the date of this      Agreement. There are no other promises, conditions, understandings or other agreements,      whether oral or written, relating to the subject matter of this Agreement. This Agreement may      be modified in writing and must be signed by both the Hirer and the Lessor.
